Am I Entitled to a Child Support Reduction in New Jersey if I Have Another Child in a Different Relationship?
The ink was barely dry on Salvaggio Law Group’s recent Blog Post about the effect of remarriage on child support in New Jersey, when we received a call regarding another child support issue which frequently arises: Am I entitled to a child support reduction in New Jersey if I have another child in a different relationship?
The answer is maybe.
One of the line items included in the New Jersey Child Support Guidelines Worksheet is what is called the “other dependent deduction.” That deduction is part of an adjustment mechanism to apportion a fair share of each parent’s income to all of his/her legal dependents, including those from other relationships who are born before or after the child(ren) for whom support is then being determined.
The first step in the process of determining the effect of the “other dependent deduction” is to create a New Jersey Child Support Guidelines Worksheet, ignoring the child(ren) of the other relationship.
The second step is to create a New Jersey Child Support Guidelines Worksheet for the child(ren) of the other relationship, based upon the income of the child(ren)’s parents.
The third step is to insert the child support amount from the second Worksheet into the first Worksheet as an “other dependent” deduction, which will change the child support amount in the first Worksheet.
The final step is to compute the average of the child support amounts in the first Worksheet and the third Worksheet. This average is the adjusted level of child support indicated by the Guidelines, because of the child(ren) of the other relationship.
